Terms & Conditions

These Terms govern your use of MERK Professional Profiles and related services provided by MERK Digital.

Last updated: 1 September 2026

1. Introduction

These Terms & Conditions ("Terms") govern access to and use of the MERK website, platform, Professional Profiles, and any related digital services (collectively, the "Service") offered by MERK Digital ("MERK", "we", "us" or "our").

By creating an account, purchasing a plan, submitting a profile setup request, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. About MERK Digital

MERK provides a digital platform that allows professionals, companies, and teams to create, manage, and share Professional Profiles using NFC, QR codes, links, and related tools.

MERK may offer subscription plans, optional setup or update services, analytics features, and other products described on our website or during checkout.

3. Eligibility and Accounts

You must be at least 18 years old, or the age of legal majority in your country, to create an account and purchase a paid plan.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when registering or updating your account.

MERK may suspend or terminate accounts that contain false information, violate these Terms, or create security, legal, or operational risk.

4. Subscriptions, Plans, and Billing

Paid plans, renewals, upgrades, downgrades, and billing cycles are described on the pricing page and during checkout. Unless otherwise stated, subscriptions renew automatically at the end of each billing period until cancelled.

Prices, taxes, and available payment methods may vary by country. You authorize MERK and its payment providers to charge the applicable fees for your selected plan and any approved add-on services.

Failure to pay may result in suspension or loss of access to paid features. Any statutory consumer rights applicable in your country remain unaffected.

5. Profile Content and User Responsibilities

You retain ownership of the content you submit to your Professional Profile, including text, images, links, files, and other materials ("User Content").

You grant MERK a non-exclusive, worldwide license to host, store, reproduce, display, and distribute your User Content solely for the purpose of operating, improving, and providing the Service.

You are solely responsible for the accuracy, legality, and appropriateness of your User Content and for ensuring that you have all rights necessary to publish it through MERK.

6. Optional Setup and Update Services

If you purchase an optional Profile Setup or Update Service, MERK will process the information you provide in order to prepare or update your profile according to the selected service.

By requesting immediate performance of a setup or update service, you acknowledge that cancellation and refund rights may be affected once work has begun, as explained during purchase and in our Cancellation & Refund Policy.

7. Acceptable Use

You agree not to misuse the Service. Without limitation, you must not upload unlawful, misleading, infringing, harmful, or offensive content; attempt to access accounts or systems without authorization; interfere with platform security; or use MERK for spam, fraud, or unauthorized commercial solicitation.

MERK may remove content, restrict functionality, or suspend access where necessary to protect users, comply with law, or enforce these Terms.

8. Intellectual Property

The MERK brand, website, software, design, and underlying technology are owned by MERK Digital or its licensors and are protected by applicable intellectual property laws.

Except for the limited rights expressly granted under these Terms, no license or ownership interest in MERK materials is transferred to you.

9. Availability and Changes

We aim to keep the Service available and reliable, but uninterrupted access is not guaranteed. Maintenance, updates, third-party outages, or events beyond our reasonable control may affect availability.

We may modify features, plans, or these Terms from time to time. Material changes will be communicated through the website, email, or your account where appropriate. Continued use after changes take effect constitutes acceptance of the updated Terms.

10. Disclaimer and Limitation of Liability

The Service is provided on an "as available" basis to the extent permitted by applicable law. MERK does not guarantee specific business results, profile visibility, or third-party platform performance.

To the maximum extent permitted by law, MERK shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from use of the Service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights.

11. Termination

You may stop using the Service at any time and may cancel your subscription according to our Cancellation & Refund Policy.

MERK may suspend or terminate access if you breach these Terms, fail to pay applicable fees, or if continued provision of the Service becomes impractical for legal or operational reasons.

12. Privacy and Cookies

Our Privacy Policy explains how we collect and process personal data. Our Cookie Policy explains how cookies and similar technologies are used on this website.

By using the Service, you acknowledge that you have read those policies.

13. Governing Law and Contact

These Terms are governed by the laws applicable to MERK Digital, without prejudice to mandatory consumer protection rules in your country of residence.
